DUI Overview
DUI stands for driving under the influence. In other states, it may be referred to as DWI (driving while intoxicated), OUI (operating under the influence) or OWI (operating while intoxicated.) In Arizona, a driver may not operate a motor vehicle while with a blood alcohol concentration above .08%, or while his or her normal abilities are impaired due to alcohol and/or a controlled substance. A "controlled substance" may include any prescription drug, narcotic or over-the-counter medicine, even when lawfully prescribed or taken. Operating a motor vehicle with diminished mental or physical capacity is enough to result in DUI charges, although these cases are most often associated with failed breath or blood tests.

The DMV hearing is the driver's opportunity to challenge the suspension of his or her driver's license in conjunction with his or her DUI arrest. The license suspension process automatically begins when a driver is arrested for DUI, and to have a chance of having the DMV reinstate his or her driving privileges the driver must request a hearing within 15 days of his or her arrest, or forever lose the ability to challenge the suspension.
